Hail vs. Collision Total Loss: What Happens to Your Title in Colorado
Two vehicles can both be written off in the same week and walk away with completely different paperwork. That difference is worth understanding before you sign anything, because it decides whether your car is worth keeping.
Start with hail. Under Colorado Revised Statute § 42-6-102(17)(a), the legal definition of a salvage vehicle specifically excludes vehicles declared a total loss solely due to hail damage. A car totaled by hail in Colorado keeps a clean title. That is a genuine advantage: you can take the settlement, keep the vehicle, and still sell it later without the branded-title discount.
Collision is different. There is no comparable exclusion for a vehicle written off after a crash, and a collision total loss that is repaired and resold typically carries a branded title. Branded titles reduce resale value, can complicate financing, and sometimes make insurance harder to place. That is why the keep-or-surrender decision carries more weight on a collision claim than it does on a hail claim.
Where things get messy is mixed damage. A vehicle with heavy hail damage that also took a collision hit, or a hailstorm that cracked the windshield and bent trim, can be handled differently from a pure hail loss. Document which damage came from which event, keep your photos, and ask the insurer in writing how the title will be branded before you accept a settlement. If the answer does not match what you believe the law says, that is the moment to push back — before the file closes.
Whichever kind of loss you are facing, the same principle applies: your vehicle is worth more than the first number in front of you. Trim, options, recent maintenance, and documented condition all move the valuation, and most drivers never submit any of it.
