Hail Totaled Your Car in Colorado? You Still Keep a Clean Title
One of the biggest fears we hear at the shop is simple: "If my car gets totaled, doesn't it get a salvage title?" For hail damage in Colorado, the answer is no.
Under Colorado Revised Statute § 42-6-102(17)(a), the legal definition of a "salvage vehicle" specifically excludes vehicles that are declared a total loss solely due to hail damage. If a vehicle suffers severe hail damage in Colorado and the insurance company writes it off as a total loss, the car retains a clean title.
That single fact changes the math for a lot of drivers. It means you can be paid the actual cash value of your vehicle by your insurer, and — if you choose to keep the vehicle — you are not stuck with the resale penalty that comes with a branded title.
